ORDER BELOW EXH.01
1. This is an application for condonation of delay of 170 days
caused to file the complaint under section 138 of Negotiable Instrument Act.
2. It is contended that due to dreadful effects of COVID-19
complainant could sent the demand notice on time and was delayed filing
present proceeding. As such the delay of 170 days has been caused in filing
the complaint.
3. The opponents duly served but fairly consented to condone the
delay subject to costs to Legal Aid Fund.
4. Heard both sides.
5. The reason shown for delay is probable looking into known
effects of COVID-19 on entire society. The delay is satisfied. Further, the
delay is not intentional nor it will take away the statutory right of the
complainant/applicant. The advocate for opponents has fairly shown ready
and willingness to go for trial. Hence, I pass following order.
O R D E R
1) The delay stands condoned subject to costs of Rs.1,000/-to be
paid to Legal Aid Fund.
2) Costs are condition precedent for registration of the complaint.
3) Order dictated and pronounced in open court.
