ORDER BELOW WITHDRAWAL APPLICATION EXH8
IN C.C. NO. 663/MISC/2019
IN CC NO.152/DV/2015
The applicant, i.e. respondent in DV case
No.152/DV/2015, filed this execution petition for execution of consent
terms, as applicant in the said case failed to comply the consent terms
by paying remaining amount of Rs.2 Lacs. The parties are referred with
their original status in the DV petition.
The applicant had agreed to pay Rs.4 Lacs to the
respondent. She paid Rs.2 Lacs in cash and Rs.2 Lacs by cheque of Rs.1
Lac each. The cheque given by the applicant was dishonored.
Therefore, this petition is filed. Applicant paid the amount of Rs.2 Lacs
to the respondent after filing of present petition by payment of
Rs.50,000/ as per receipt dt.14.02.2020 Exh6, receipt of Rs.75,000/
dt.27.02.2020, Exh7. Today, the applicant paid amount of Rs.75,000/.
Thus, respondent sought to withdraw the application, as the consent
terms have been fully complied with.
Applicant have been identified by the advocate. He
identified his signatures and affirms the contents and receipt of
Rs.75,000/. Thus, permission granted, as prayed for. Order followed
below Exh1.
