In view of letter no. B(Gen)-1001/2026/1196 dated 27th July,
2026 of Hon’ble Bombay High Court the matter is taken in special drive.
Perused the proceeding. The present complaint is filed in the year 2019 for
the offence punishable U/Sec 138 of the Negotiable Instruments Act.
02. Record reflects that the complainant is continuously absent since
last several dates. Today also, neither the complainant nor the advocate
representing the complainant is present when called out. As per section
143(3) of the Negotiable Instruments Act, the present case is required to be
disposed of within six months from the date of filling of the complaint. The
Complainant has not shown the satisfactory reason of absence. The
complainant failed to take further steps. No fruitful purpose will be served
by keeping the case pending any more in absence of any step taken by the
complainant. Hence, the order.
- ORDER -
1. The complaint is dismissed for non appearance of the complainant.
2. Accused stand(s) acquitted of the offence punishable under section
138 of the Negotiable Instruments Act
vide section 256 of the Code of
Criminal Procedure.
3. Bail bond of the accused, if any stands cancelled.
4. NBW if any, be called back forthwith.
