COMMON ORDER BELOW EXH.1
(In C.C. Nos. 2265/PW/2024 and 2266/PW/2024)
1. Yesterday, in these matters the accused Mr. Ravi Agyaram Gupta,
is appeared before this court through video conferencing. He pleaded
guilty to the offences in these two matters. He is totally made aware of the
consequences of his pleading guilty to the offences. Despite that he is
ready to plead guilty, as such his plea is voluntary.
2. In these two matters it is alleged that accused stolen mobile phones
of the certain value. Heard Ld. A.P.P. and accused on the point of
sentence. Ld. A.P.P. for severe sentence. However, accused prayed for
leniency on the ground of poverty and compelling circumstances leading
to committing act of theft. These are the only acts alleged against him
mentioned in the record. There is substance in the grounds pleaded, one
opportunity is necessary by showing leniency in sentence. Considering
the nature of offence, the property involved and the period undergone by
the accused, following order :
ORDER
A. Accused is convicted in the two matters mentioned above under
Section 241 of the Code of Criminal Procedure, for an offence punishable
under Section 380 of Indian Penal Code and sentenced to suffer simple
imprisonment for one month for offence punishable under Section 380 of
Indian Penal Code. Sentences in these two matters shall run concurrently.
B. He is entitled to set off as per Section 428 of the Code of Criminal
Procedure. As he is in jail since 29.06.2024 and 04.07.2024 respectively,
the punishment has already been undergone by him, therefore, he shall be
released forthwith if not required in any other offence.
C. The mobile phones seized, shall be handed over to
informant/victim.

D. Copy of this order shall be kept in all the three matters.
E. Copy of this order to be given free of cost to the accused.
F. Inform Jail Authorities accordingly.
