ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant his laptop, details of which are mentioned in the
application, is seized by respondent in connection with an offence
registered with respondent police station at C.R. No.303 of 2021, for an
offence punishable U/Sec.406, etc. of Indian Penal Code. The investigating
relating to said article is over. He is in need of it. Therefore, he filed present
application for handing over custody of it.
3. Say of the respondent was called. Investigating Officer informed that
applicant/accused being director of company committed fraud on informant
and siphoned of huge amount of provident fund of employees of informant
company. In connection with the said transactions the article seized on
15.06.2019 and sent to forensic examination for collection of additional
evidence. It constitutes important evidence and can not be returned.
4. The submissions of both the parties are in tune with respective
contentions. From the record and objections raised it is clear that a laptop
claimed by applicant is sent to Forensic Examination and constitutes
important evidence. Therefore, it can not be returned. The allegations are
serious. Huge amount is involved. As such it can not be returned. There
found no justifiable ground to return the article seized. Therefore, following
order -
ORDER
The application is rejected.
