ORDER BELOW EXH.1
1. Applicant/informant has filed this application to deliver the
cash worth Rs.41,000/- to him on any conditions. Perused application
and say of I.O, Ld. A.P.P and accused. Heard both side. The I.O., Ld.
A.P.P. and accused have no objection to deliver the seized cash to the
applicant on conditions.
2. The F.I.R. shows that, applicant has lodged F.I.R. alleging that,
accused have deceived the informant to deposit Rs.65,800/-. Said
amount is debited from his account and credited to the different
accounts. Out of which Rs.8,700/- and Rs.17,000/- he got back.
However, the accused have cheated the informant. The applicant
realized the fraud. Hence, he has registered the F.I.R. at Dharavi Police
Station. No one, except applicant, has claimed the seized cash till date. It
is necessary to consider that, said cash is of informant, if it is not
released in favor of applicant, he will suffer economic loss. Therefore,
applicant is entitled for interim custody of seized cash on indemnity
bond. Hence, order:
Order
1. The seized cash worth Rs.41,000/- be delivered to applicant on
executing supurtnama (indemnity bond) of Rs.41,000/- (Rupees Forty
One Thousand only) before the I.O. on the following conditions namely:
a) He shall deposit said amount before the Court as and when
required.
2. Investigating officer is directed to take appropriate colour
photographs of the cash and to prepare panchanama of the cash before
handing over it in favour of the applicant and further directed to produce
the panchnama, photographs and supurtnama before the Court
alongwith charge-sheet.
3. Present proceeding be merged in the main proceeding.
