Order Below Application by accused Priyanshi, Exh.117
1. By way of this application, one of the accused Miss Priyanshi
Kandpal, sought access to her email addresses mentioned in the
application and also sought return of certain hardware seized by
Investigating Officer, during investigation.
2. So far as hardware are concerned it is noticed that they are sent to
Forensic Analysis and are constituting major part of evidence, therefore,
hardware can not be returned.
3. Regarding access to email addresses mentioned in the application,
it is contended that applicant is in need of such access for the purpose of
retrieval of her official documents. So also there is material including her
resignation letter with her erstwhile employer which will support her
defence.
4. Ld.A.P.P. objected to the application, but not seriously objected to
this relief. Considering the nature of the allegations access seems
necessary. But such access and decision on it needs to be taken by
Investigating Officer and that too after consultation with experts as
allegations are serious and amplitude of the investigation is very wide.
5. Accordingly, following order -
ORDER
a. The application is rejected.
b. The applicant is however at liberty to approach Investigating
Officer and sought permission to access her email addresses mentioned in
the application.
c. The Investigating Officer shall take decision on her application and
can permit access to the applicant to the email IDs mentioned in the

present application, in his presence and shall also allow her to retrieve the
data, if permission is granted.
d. Copy of this order shall be sent to concerned Investigating Officer.
