ORDER BELOW APPLICATION OF APPLICANT/ACCUSED SEEKING
PERMISSION TO TRAVEL ABROAD & NOC FOR RENEWAL OF PASSPORT
1] This is an application filed by applicant/accused Ziauddin Abdul
Rahim Siddique in connection with M.E.C.R. No.01/2014 registered for the
offences u/s.420, 469, 466, 467, 468, 471, 34 of I.P.C. by Bandra Police Station
seeking permission to travel abroad as well as no objection for renewal of
passport.
2] The applicant submits that he is holding passport vide no.
F2794096 which is expiring on 19/04/2020 and hence he is seeking permission
for renewal of the passport. He has filed verified copy of relevant page of
passport showing details on record.
3] The applicant further submits that he is businessman by profession
and has to travel frequently to different countries. He needs the passport for
10 year and till that period he seeks permission to travel abroad.
4] The Investigating Officer filed say and submitted that the
investigation of this crime is yet to be completed. Hence, prayed necessary
order be passed. Ld. APP submitted that the investigation is in progress. If
permission is granted the accused might abscond and delay trial. Hence, prayed
for rejection of application.
5] Perused application, documents, say and affidavit in support of
application. Heard advocate for applicant. The applicant who as per entry in
application also his own contention is permanent resident of Mumbai, is not
charged for heinous crime against public order. Since he is represented by

pleader I do not find that the progress of the case would be hampered, if he is
granted permission for renewal of passport.
6] However, so far as his prayer for permission to travel abroad is
concerned it is not supported by any travel schedule. Neither the period for
which he desires to proceed to foreign destination is mentioned nor the place
disclosed. As such the same cannot be allowed. On 12/02/2020 the applicant
filed affidavit in support of his prayer and submitted, the prayer for permission
to travel abroad be not pressed.
7] Considering the above, I deem fit to allow the application as
follows:
O R D E R
i] The applicant/accused Ziauddin Abdul Rahim Siddique is
hereby given no objection for renewal of passport which be
considered by the passport authority in accordance with law.
ii] Prayer of permission to travel abroad is not pressed by the
applicant, hence no order in that respect.
