Order Details: Order Below EX 1 Pdf Text: C. C. No. 2114 PW 2023 State Vs Sohel and ors. CNR No.MHMM18-009069-2023 ORDER BELOW EXH.1 1. Today the accused Mr. Sohel Imran Shaikh @ Kutti, is appeared before this court through video conferencing. The accused pleaded guilty to the offence. His plea is voluntary as despite giving clear understanding to him about the effect of punishment, he has pleaded guilty to the offence. Plea accepted. 2. Heard him on the point of sentence. He prayed for leniency. Accused is in custody since 17.09.2023. Accused had stolen the various articles and cash, of total value of Rs.12,600/- and he is in jail for about two months. Therefore, considering the nature of offence and his prayer, following order : ORDER A. The accused Mr. Sohel Imran Shaikh @ Kutti, is convicted under Section 241 of the Code of Criminal Procedure, for an offence punishable under Section 394 r/w.34 of Indian Penal Code and sentenced to suffer simple imprisonment for two months. B. Accused is entitled to set off as per Section 428 of the Code of Criminal Procedure, from the date of his detention i.e. 17.09.2023. He shall be released forthwith after completion of his sentence i.e. on 16.12.2023, if not required in any other offence. C. The property seized shall be handed over to informant. D. The matter is ordered to be proceeded against remaining accused persons who are already on bail. E. Copy of this order to be given free of cost to the accused.
