1. Perused record. Heard Ld. A.P.P.
2. It is informed that after investigation no offence is found to be
transpired, therefore, C Summary shall be granted and proceeding shall be
dropped. Ld. A.P.P. in tune with the finding recorded submitted that he has
no objection to accept the report and pass necessary orders.
3. The record shows that, at the instance of first informant offence was
registered and investigation commenced. During investigation it is
transpired that offence lodged out of mistake occurred due to
misunderstanding of circumstances. The statement of the informant
recorded and other documents collected, during investigation clearly shows
that no such incident occurred as narrated in the First Information Report
and out of misunderstanding the offence was registered. There is no need of
issuance of notice in view of the facts transpired by disbelieving the
Investigating Officer. Thus, there is no hindrance in accepting the report.
Accordingly, following order :
ORDER
1. C summary is granted.
2. The matter is disposed off. Accused, if arrested also discharged. Bail
bonds, if any, stands canceled.
