1. Today the matter is taken before this Court in Special Drive. Perused
record. The present report is filed against the accused in respect of an
offence punishable under Section 66 of Maharashtra Prohibition Act. The
maximum punishment provided for this offence is fine and imprisonment
upto three years.
2. As per Section 468(2)(c) of Code of Criminal Procedure, the
maximum time provided to take cognizance for the offences with which the
accused is charge sheeted is three years. The record shows that the present
final report filed after elapsing said period of limitation. Thus, cognizance is
barred by limitation and hence, following order :
ORDER
Final report is rejected.
