ORDER BELOW EXH.1 IN C.C.NO. 2118/PS/2021
Perused the record. It appears that the chargesheet is filed
u/sec.65 (E) of the Bombay Prohibition Act. The record further shows
that till today, police machinery miserably failed to execute summons
on accused. Sufficient an d considerable opportunity as well as time is
given to police machinery. Case is 3 years old. C.A. report is filed on
record.
Hence, in such situation, no purpose will be served by
keeping it pending. Therefore, in such facts & circumstances, the
proceeding of the case is stopped u/sec.258 of the Code of Criminal
Procedure. The accused are acquitted and their bail bonds, if any be
canceled. The seized country liquor be forwarded to Excise Department
and remaining muddemal be destroyed. Seized Tata vehicle bearing No.
MH-02-ER-1298 be returned to it’s original owner, after due
verification. It be closed.
