This is an application filed by the accused to set aside, no
say order passed against him on the application filed by the
complainant at Exhibit-19. As per the contention of the accused, due
to the change of advocate the accused could not filed his say. Now,
the accused wants to contest the application.
2. By filing the say on the application itself, the complainant
resisted the application. As per the contention of the complainant, the
application is filed in November 2024. After awaiting for the whole
year the application proceeded with unilateral hearing. The
complainant is senior citizen. The delay is already caused due to
lethargic conduct of the accused. Hence, the complainant has prayed
for rejection of the application and alternatively for direction to the
accused to file say today itself.
3. Heard both sides. Gone through the documents on
record.

4. The matter is of 2019. The application Exhibit-19 has
been filed on 7th November 2024. No say order has been passed on
16th October 2025. This application is moved after lapsed of nine
months. Thus, considering the reason mentioned in the application,
nature of the proceeding, it is just and proper to give opportunity to
the accused to file his say. Hence, the application is allowed subject to
following terms:
1. The accused shall filed his written say today itself.
2. Upon failure to comply the said order the application be
treated as rejected.
