ORDER
Read complaint, verification of complainant. Perused the
documents placed on record.
Heard Ld. Advocate for complainant. According to the
complainant accused persons have by making false representation
regarding repayment of loan availed huge loan from complainant by
giving security of commercial vehicles. Accused did not repay the loan
nor they have given any inception of secured commercial vehicles. Thus,
according to the complainant accused cheated him.
The complainant’s verification statement discloses that,
accused falsely represent regarding repayment of loan and did not
repay the same nor they are allowing inception of secured vehicles to
complainant. Hence, complainant made out
prima-facie case. Therefore,
issue process under section 420 r/w.s. 34 of I.P.C. against accused
persons.
Accused are discharged from the offence punishable under
sections 120 (b), 467, 406 of Indian Penal Code, as no case
prima-
faciely made out by complainant against them.
Case be registered Summons Warrant(SW) case.
