ORDER BELOW APPLICAITON FOR TRAVEL PERMISSION

1. Perused record. Heard both the sides.
2. This is second application filed by accused seeking travel
permission in the various places/countries as mentioned in prayer clause.
It is contended that such permission is needed as he wants to leave India
for holidaying with his family. He is ready to remain abide by the
conditions, if any, imposed and will remain present during future stages of
trial after returning to India.
3. Ld. A.P.P. not seriously objected to it and simply mentioned that
offence is cognizable and non-bailable and there is possibility that
accused may not turned up for trial.
4. The accused is temporarily leaving India. Ld. Advocate brought to
notice that the amount, about which the present matter is pending i.e.
Rs.40,00,000/- is already paid to the informant. He has filed on record the
copy of affidavit of informant and also drawn attention towards the order
passed by High Court in Criminal Writ Petition No.6278 of 2019, and
subsequent orders passed by this court. The order of this court dated
29.11.2019, and affidavit of the informant Mr. Rashid Siddiqui, reflects
that matter between him and applicant/accused is amicably settled and in
pursuance of it amount of Rs.40,00,000/- is already paid to him.
5. The commencement of trial and disposal of matter will take much
time. Accused is leaving India temporarily. Considering these aspects and
above discussed facts and circumstances, following order -
ORDER
1. Application is allowed.

2. Applicant/Accused Mr. Hardik N. Gothi, is permitted to leave India
for the countries and during period mentioned in the prayer clause of the
application from 22.06.2022 to 06.07.2022.
