ORDER BELOW EXH.1
1. Perused record, verification and heard Ld. Advocate for the complainant.
2. The present complaint is filed against six proposed accused persons, who
are office bearers of society, were complainant is residing mainly alleging that as
he opposed certain actions of committee members they moved a Censure Motion
and passed resolution against him, vide minutes of Special Meeting dated
04.04.2019. The copy of these minutes are on record. The complainant have
grievance in respect of the subject mainly alleging that he issued threats to the
president of the society with dire consequences and legal action. The said action
on the part of accused persons caused defamation. He alleged that he had never
issued any such threat.
3. Except the minutes and other aspects pertaining to previous complaints
made by complainant, there is no material produced on record. The gist of the
matter is truthfulness or falsity of the alleged acts of threat i.e. basis of the
resolution and consequent minutes dated 04.04.2019. The relevant material needs
to be corrected along with necessary evidence, if any, to come to proper
conclusion. Therefore, following order :
ORDER
P.S.O., Police Station Bandra, is herewith directed to investigate as per
Section 202 of Code of Criminal Procedure, the allegations and file report within
two months from today. It is directed to him that while carrying out this
investigation he shall collect copies of all the relevant documents of meeting
dated 04.04.2019, and minutes of proceeding of the said meeting.
