ORDER BELOW EXH.01
The first informant appeared with his advocate. He has produced
his photo identity for identification. Advocate of the accused is also present. The
first informant stated that he wishes to compound the case with the accused and
filed pursis below Exh. 2 to that effect. He admitted the contents of the
application. The offence u/sec.379 of the Indian Penal Code is compoundable
u/sec.320 of Code of Criminal Procedure. In view of pursis below Exh.2, the case
will have to be disposed off. In the result, following order is passed.
ORDER
1. The case is disposed off in view of compounding of offence in accordance
with Exh. 2, which shall form part of this order.
2. The accused is acquitted of the offence u/sec. 379 of I.P.C.
3. The accused be released forthwith.
4. Seized property be returned to the first informant/owner.
5. Case papers be filed.
