ORDER BELOW APPLICATION EXH.45
1. This is the application for extending more time to deposit the
amount of 20% compensation to the extent of share of accused No.5.
2. Heard both sides.
3. Basically the application is illegal and unwarranted by law as
the order passed by this court is self explanatory considering the vicarious
liability of the all accused persons. This court is not empowered with the
right of partition and decide shares of all accused. The order is not
complied by any of the accused. The application moved by the advocate
for accused No.5 seems to have moved only to protract the litigation
without complying the order for an interim compensation. Hence I pass
following order.
O R D E R
1) The application is rejected.
2) The accused to comply the order of interim
compensation dated 08.01.2024.
3) Order dictated and pronounced in open court.
