Cross examination of CW-01- Jayesh Hataple by advocate Mrs.Swati Shinde
for the accused :
14. The affidavit in lieu of examination in chief is drafted as per my
narration. I know the contents of evidence affidavit and information given
therein. I have not brought original minute books and original copy of Board
Resolution whereby I am authorized to represent the complainant. I have not
produced any document in regards partnership firm of accused in the
proceeding. The loan documents formats are same and similar for all type of
loans. It is true to say that the hand written information in the agreement is
filled in by me personally. I can not tell whether I have produced any
document to show receipt of notice dated 27.08.2019 recalling the entire
loan facility in the proceeding. It is not true to say that no such notice for
recalling entire loan facility was ever sent to the accused. It is not true to say
that accused have not received any such recall notice dated 27.08.2019. It is
not true to say that accused has not issued subject cheque after or pursuant to
recall notice. It is not true to say that the cheque Exh.21 was issued by the
accused towards security of the loan and not pursuant to recall notice. It is
not true to say that I have filed present complaint to harass the accused.
