ORDER BELOW EXH.1
1. Accused produced with charge sheet. He is taken in M.C.R. He
pleaded guilty to the offence. He is totally made aware of the
consequences of the pleading guilty to the offence. Despite that he is
ready to plead guilty. His plea is voluntary.
2. Heard him on the point of sentence. He prayed for leniency.
Accused had stolen the scooter of Honda company, bearing registration
No.MH-01-CG-5239, of value of Rs.30,000/-. He is in custody since
25.10.2023. He is poor and of tender age. It is also submitted that there
are dependents on him. It is his first offence. Therefore, considering the
nature of offence, grounds for leniency and these facts and circumstances,
following order :
ORDER
A. The accused is convicted under Section 241 of the Code of
Criminal Procedure, for an offence punishable under Section 379 of
Indian Penal Code and sentenced to suffer simple imprisonment for ten
days.
B. Accused is in custody since 25.10.2023. He is entitled to set off as
per Section 428 of the Code of Criminal Procedure. As he is in custody
since 25.10.2023, after undergoing the remaining punishment, he shall be
released if not required in any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
