ORDER BELOW EXH.01
The complainant and advocate absent. Process issued on
25.05.2022. summons issued to accused returned with remark ‘left
address’ on 19.10.2023 and 23.10.2023. Thereafter, on 22.05.2024,
complainant directed to take appropriate steps vide order below Exh.01.
No further effective steps taken except moving application for reissuing
summons on 29.08.2024 to secure presence of accused. Thereafter, neither
complainant nor advocate present or taken appropriate steps. Keeping the
file pending years together without proceeding further, taking appropriate
steps by the complainant is unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case. Hence, I
pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused are acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
