Order Below Bail Application
1. The accused persons Mr. Ujjwal Raj Avadesh Kumar Singh, Mr.
Shubham Kumar Jaipal Singh Pardesi, Mr. Aditya Dilip Shinde @ Lucifer
have filed the bail application. Perused application and say filed by Ld.
A.P. P. and I.O. Heard both side.
2. The accused are charged for offence punishable under Sections
319(2), 318(4), 238, 61 of the B.N.S. and Section 66-C, 66-D of the I.T.
Act. It is alleged that all the accused have made conspiracy and cheated
the informant for Rs.1,93,06,000/-. Huge amount involved. Offence is
non-bailable. Considering the modus operandi and the nature of offence
and the accused are not entitled to enlarge on bail. Ld. Advocate for
accused has relied on Vihaan Kumar Vs State of Haryana and anr.
(Criminal Appeal No. of 2025 arising out of SLP(Crl.) No.13320 of
2024), Prabir Purkayastha Vs State (NCT of Delhi) (Criminal Appeal
No(s). of 2025 arising out of SLP(Crl.)No(s).42896 of 2023) and Vijay
Kumar Ghai and ors. Vs The State of West Bengal and ors. (2022
LiveLaw (SC) 305). I have perused the cited case laws. The above
discussed facts of the case in hand are not involved in the cited case law.
Therefore, with utmost respect, I am of the view that, the cited case
laws are not applicable to the case in hand. Accordingly I proceed to
pass following order :
ORDER
1. Application is rejected.
2. Intimation of this order be sent to accused immediately through
