Application for Return of Property
1. Read the application. The applicant / informant claimed that she
has lodged the report in Mahim police station for the offence
punishable U/sec. 392 r/w 34 of IPC and crime No.08/2014 is
registered. She claimed that she is the owner of the Mangalsutra of 25
grams worth Rs.60,000/.
2. Ld. APP filed her say underneath the application and submitted
say that property claimed by applicant is required during trial and
conditions may imposed upon the applicant. I.O. may also directed to
obtain photographs, and prepare panchanama of the property. I.O.
filed the say and submitted that the property is recovered and he has no
objection to return the said property. Accused also filed the say
underneath the application and submitted his NOC.
3. Heard the Ld. Counsel for the applicant. In the affidavit applicant
has submitted that the said mangalsutra was given her in marriage and
she has not any document in respect of that. Report is lodged by apC.C.

following order :
O R D E R
The Inspector of Mahim Police Station, if in possession of the gold
Mangalsutra mentioned in the application, shall hand over the same to
the present applicant.

Before that the applicant to furnish Indemnity Bond for
Rs.60,000/ (Rupees Sixty Thousand Only) undertaking to the effect
that,
(a) she will not alienate, destroy, give on rent or part with the
possession of the above property,
(b) she will produce the property before the Police Station or the
Court as directed by this Court.

(c) That the applicant to furnish photograph of the mangalsutra to
the police station, which later on to be filed alongwith the final
report in the Court by the police.
