ORDER BELOW EXH.1
A. Perused record. Prima facie case made out. Cognizance taken of
offence punishable under Sections 324, 330, 384, 386, 364-A and 365
r/w.120-B and 34 of Indian Penal Code. Issue process against the accused
persons for the said offences.
B. Accused persons present before this court, they are taken in M.C.R.
In view of law laid down by Supreme Court in the case of Siddharam
Mhetre Vs State of Maharashtra, accused are released on bail on same terms
and conditions, as laid down by High Court, while granting Anticipatory
Bail No.576 of 2020, dated 26.08.2021.
C. The principal offence is triable by Court of Sessions. The copies of the
police report and other documents as specified in the Section 207 of the Code
of Criminal Procedure have been supplied to the accused. The case be
committed to the Court of Session.
D. Accused is directed to appear before the Court of Session on 06.01.2023.
E. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Court of Session.
F. The Police Station Officer, Police Station Dharavi, be directed to
produce muddemal property in the Court of Session on or before 06.01.2023,
positively.
G. The Public Prosecutor shall be notified of the commitment of the case to
the Court of Session.
H. Record and proceedings be sent to the Session Court, Greater
Bombay.
