ORDER BELOW EXH.1
Applicant seeking permission to alienate the BMW Car
bearing No. MH43BE4749.
2. IO and Ld. APP resisted the prayer.
3. Admittedly, BMW Car bearing No. MH43BE4749 was
handed over to the applicant, on a condition not to alienate the same in
any manner till the disposal of the case. IO and APP resisted the prayer,
as it required for the trial. However, trial may take its own time.
Already directions were given to take the photographs of the said car
prior to the release. The said directions are complied. The order of
release was passed long back. Applicant cannot be prevented from
alienating the said car only for the sake of trial of the case. I do not find
any merit in the objection raised by IO and APP. Application deserved
to be allowed. Hence, following order is passed.
ORDER
1. Application is allowed.
2. Applicant is permitted to alienate the BMW Car bearing
No. MH43BE4749. The indemnity bond stands discharged.
3. The copy of said order be annexed to the concerned case.
