ORDER BELOW EXH.1
1. Today the accused persons appeared before this court through video
conferencing. The accused pleaded guilty to the offence. Their plea is
voluntary as despite giving clear understanding to them about the effect of
punishment, they have pleaded guilty to the offence. Plea accepted.
2. Heard them on the point of sentence. They prayed for leniency.
Accused are in custody since 07.08.2022. Accused had stolen the motor
tempo of Maruti company, bearing registration No.MH-02-FG-7920, of
value of Rs.5 lacs and they are in jail for more than one month.
Therefore, considering the nature of offence and his prayer, following
order :
ORDER
A. All the accused persons are convicted under Section 241 of the
Code of Criminal Procedure, for an offence punishable under Section 379
r/w.34 of Indian Penal Code and sentenced to suffer simple imprisonment
for one month.
B. They are entitled to set off as per Section 428 of the Code of
Criminal Procedure. As they are in jail since 07.08.2022, the punishment
has already been undergone by them, therefore, they shall be released
forthwith if not required in any other offence.
C. The property seized already handed over to informant.
D. Copy of this order to be given free of cost to the accused.
