ORDER ON APPLICATION FOR RELAXATION OF BAIL CONDITION
(EXH.14)
1. This is second application filed by accused Mr. Basab Biraja Paul,
for relaxation of one of the bail condition regarding prior permission of
this court before leaving India.
2. It is contended that investigation is already over. Charge sheet
filed. Applicant has business all over the world, involving impromptu and
unplanned itineraries and particularly runs business in Barcelona. The
condition is in violation of his fundamental rights. It is difficult for him to
obtain permission of this court again and again, therefore, applicant
sought deletion of condition No.iv, of Order Clause - b.
3. The Ld. A.P.P. objected stating that allegations are serious and
there is possibility of absconding and as such trial may be hampered.
4. The order clause imposing conditions runs as, “iv. Accused shall not
tamper with prosecution evidence in any way and obtain permission from this court
before leaving India.”. Now investigation is over. Charge sheet already
filed. Accused possesses various landed properties in India and
particularly at Mumbai. There is substance in the grounds assigned.
Therefore, following order -
ORDER
The application is allowed. The order clause imposing bail
conditions is modified as, “iv. Accused shall not tamper with prosecution
evidence in any way and shall inform to this court before leaving India, along with
itinerary”.
