Subhash Ramji Thakkar
Perused the record. It appears that the chargesheet is filed
u/sec.65 (E), 81, 83, 108 of the Bombay Prohibition Act. The record
further shows that till today, police machinery miserably failed to
execute summons on accused. Sufficient and considerable opportunity
as well as time is given to police machinery. Case is 3 years old.
Hence, in such situation, no purpose will be served by
keeping it pending. Therefore, in such facts & circumstances pass
following order:
ORDER
1. The proceeding of the case is stopped u/sec.258 of the Code of
Criminal Procedure.
2. The accused is acquitted and his bail bonds, if any be canceled.
3. Seized foreign liquor be forwarded to Excise Department, Maruti Alto
car bearing No. MH-05-AJ-4598 and two Samsung mobile phones be
returned to their original owner, after due verification.
4. Proceeding is closed.
