ORDER BELOW APPLICATION FOR
NO OBJECTION FOR RE-ISSUE / RENEWAL OF PASSPORT.
1. The applicant viz. Osama Mohammad Yasin Ansari, who is an
accused in C. R. No.25/2022 has prayed for No Objection for re-issue/
renewal of passport.
2. Ld. APP opposed the application and submitted that, case is
pending since long and is fixed for recording plea of accused. Hence,
prayed to reject the application. However, if allowed plea of accused may
kindly be recorded.
3. Heard both sides at the length.
4. Perused application. Police station B.K.C. have filed the
charge-sheet against accused long back. The accused/applicant wants No
Objection for issuance of re-issue/renewal of passport and for that purpose
she seeks permission of this court. It is to be noted that, by this application
accused is not seeking permission to travel abroad. Therefore, for issuance
of renewal of passport permission can be granted. Hence, I proceed to pass
following order.

ORDER
1. The application is allowed.
2. No objection is granted to the applicant/accused for re-issue/
renewal of passport for a period of 10 (Ten) years, subject to
following conditions :
(i) The applicant/accused should not flee from the course of
justice.
(ii) The applicant/accused should appear regularly before the
court on the date fixed for hearing of the case.
(iii) The applicant/accused must obtain prior permission of the
court before leaving India, during pendency of the case
against him.
(iv) The applicant/accused to complete necessary formalities and
this permission shall not be deemed to be an alternative to any
rules or regulations or verification, which the applicant/
accused is obliged to comply with.
3. Issue letter accordingly to the concerned authority.
4. In case of breach of above conditions permission will be
treated, as withdrawn.
5. Copy of this order be kept in charge-sheet.
