ORDER BELOW EXH.-1
Perused record. It reflects that, chargesheet has been filed
on 24/08/2021. Ld. Counsel for accused repeatedly sought the
exemption till today. Today also all accused are absent. Ld. Counsel for
accused No.1 to No.4 given exemption but record reflects that, they are
continuously remained absent. So they are not entitled to exemption.
Therefore, application for exemption accused No.1 to No.4 is hereby
rejected.
2. As pertaining to accused No.7 to No.12 Ld. Counsel for
accused mentioned that, accused are residing at Gujarat and due to
heavy rain they could not attend the court but considering the nature of
alleged offence and continuous exemption particulars of offence yet not
recorded. It reflects that, there is willful delay in the matter. In such
circumstances accused No.7 to No.12 are not entitled for exemption.
Therefore, application for exemption accused No..7 to No.12 is hereby
rejected.
3. All accused are absent today. Therefore issue Standing Non
Bailable Warrant against them. Issue notice to their sureties if any.
Santacruz police station filed report of execution of warrant till next
date.
