Heard advocate for complainant and complainant in person.
Perused proceeding. Accused has failed to exercise his right of cross
examination despite giving more than sufficient opportunity. No cross
order is already passed on 23.09.2024. Complainant do not want to
lead further evidence. Record shows that accused is released on cash
bail of Rs.6,000/- on 31.10.2022. His plea was also recorded at Exh.12
on same day. Since then and thereafter accused has remained absent.
There is reason to believe that accused is avoiding his presence and
protracting the trial by jumping bail conditions. Hence, I pass following
order.
ORDER
1. The Bail Bonds of the accused stands forfeited.
2. The amount of cash bail be credited to the Government
Account.
3. The statement of accused to be recorded under section 313 of
Code of Criminal Procedure stands dispensed with.
4. The evidence of accused stands closed.
5. Issue standing NBW against accused for securing his
presence.
