1. The present matter is taken on board today in Special Drive for
disposal of petty cases. Perused record. The present prosecution is lodged in
respect for offences punishable under Sections 3 r/w. 4 of Maharashtra
Prevention of Defacement of Property Act, 1985. The maximum punishment
provided for these offences is fine and imprisonment upto six months in
both the offences.
2. As per Section 468(2)(a) of Code of Criminal Procedure, the
maximum time provided to take cognizance for the offences with which the
accused charge sheeted is one year. The record shows that the present final
report filed after elapsing said period of limitation. Thus, cognizance is
barred by limitation and hence, following order :
ORDER
Final report is rejected.
