Cross examination of CW-01- Piyush Thakkar by advocate Mr. Rajeev
Shukla for the accused after recalling :
18. I am committee member of society. I was part in fixing deal
with accused no.1. It is true to say that agreement was executed for
the same. Two agreement were executed. One was development
agreement and other was supplementary agreement with the society.
Both agreements were executed in the year 2017. I have not produced
those agreements as the same were executed with Housing Society. It is
not true to say that no such agreements were executed. It is not true to
say that therefore I have not produce it. It is not true to say that only
talks were in between me and accused but no agreement was executed.
It is not true to say that only post dated cheques were given to us.
19. It is true to say that I can not tell whose signature is on
cheque Exh.24 now shown to me. I can not tell which accused has
made said signature. It is not true to say that I deposited the cheque
personally writing contents of cheque Exh.24.
20. It is not true to say that demand made vide demand notice
Exh.26 is illegal and bad in law. It is not true to say that I have filed
present complaint to harassed the accused. It is not true to say that
accused are not liable to pay anything to me. It is not true to say that I
am deposing false. It is not true to say that accused has not received the
notice send by me. It is not true to say that I have not filed any

documents to show that accused have not received notice. I have filed
track report and accused has replied the notice. It is not true to say that
nothing is mentioned in track report produced by me to show that
notice was delivered to the accused. It is not true to say that I am
deposing false.
