ORDER BELOW EXHIBIT – 01
1. Perused record. Accused Nos.5. Farid Nazir Shaikh and 6. Nazir
Peermohammad Shaikh, filed pursis/application and pleaded guilty to the
offence. Accused are charge sheeted for an offence punishable U/Sec.12(a)
of Maharashtra Prevention of Gambling Act. They pleaded guilty to the
offence.
2. Their plea is voluntarily. They pleads for leniency mainly on the
grounds that there are dependents on them. Considering the nature of
offence and these grounds assigned I am of the opinion that rather than
awarding substantive sentence, fine will serve the purpose. Therefore,
following order :
ORDER
a. Accused Nos.5. Farid Nazir Shaikh and 6. Nazir Peermohammad
Shaikh, are convicted under Section 252 of Code of Criminal Procedure for
an offence punishable under Section 12(a) of Maharashtra Prevention of
Gambling Act and sentenced to pay fine of Rs.200/- each. In default accused
shall suffer simple imprisonment for two days each.
b. Copy of this order shall be given free of cost to the accused within
one week and also sent to concerned police station for further compliance.
