Cross examination of CW-01- Kamal Dagdu Pakhare by advocate Mr.
Rajendra Patil for the accused :
16. It is true to say that the properties mentioned in para 3 of
my examination in chief are situated at Kuathe Mahankal, Dist. Sangali.
It is true to say that the properties mentioned in para 3 are self
acquired properties of my me and accused. It is true to say that my
name is recorded as a successor in interest of my mother to the revenue
record of all above property. It is true to say that my mother and father
of accused are sister and brother in relation. It is true to say that my
grandfather Laxman Shinde has four sons and four daughters. It is true
to say that my mother is elder daughter of Laxman Shinde. It is not
true to say that the properties were partitioned in the life time of my
father. It is not true to say that at the time of alleged partition my
mother and her sisters were present. It is not true to say that my
mother and her sisters have orally relinquished their shares at the time
of partition. Witness volunteers that at that time my mother was not
alive. It is true to say that the land is in cultivation of the accused and
his brothers and they are utilizing the fruits of cultivation. I can not tell
on which date or year my grandfather Laxman Shinde expired. It is true
to say that father of accused Vikas Shinde is also expired. It is true to
say that accused has a brother two sisters. We have no visiting terms

with the siblings of maternal uncle.
17. It is true to say that accused has sent notice by Registered
Post on 21.02.2023. It is true to say that my advocate has replied the
notice dated 27.02.2023. It is not true to say that advocate of accused
has sent re-joinder of notice reply on 10.05.2023. I do not remember
whether accused had also sent notice on 17.05.2023 to me but I
refused to accept the Register Post Envelop. It is not true to say that the
lands mentioned in para 3 of Examination in Chief is acquired by the
Authority of National Highway.
On oral request of the advocate for the accused cross
examination is deferred till next date.
