ORDER BELOW EXH.-14
Perused the record. It appears that, accused sought exemption
more than 15 times. It is true as per procedure directly Non Bailable
Warrant cannot be issued but the conduct of accused seems that, they
are avoiding court proceeding.
2. Ld. Counsel for the accused insisting to the court not to
issue warrant and submitting that, there is valid order of the Hon'ble
High Court pertaining to exemption of accused.
3. On perusal of record there is no stay order pertaining to
this proceeding at this moment. Moreover, conduct of accused seems to
be prolong the matter.
4. Considering nature of the matter and it’s stage it is directed
to both parties to communicate this court, that any stay order of the
Hon'ble High Court till next date. Accused are directed to remain
present before court at 11.00 a.m. on next date, without fail. Moreover,
accused seeking continuous exemption since long time without
appearing and to furnishing their bail before this court. Mere filing of
Vakalatnama of Ld. Counsel is not sufficient to grant exemption for
years together. In such circumstances only for avoiding technicality last
exemption granted to accused with condition they shall attend the court
on next date without fail.
