ORDER BELOW BAIL APPLICATION, EXH.6
1. Perused record. Heard both the sides.
2. This is an application under Section 437 of Code of Criminal
Procedure, for bail. Accused Mr. Chandrashekhar Hariprasad
Vishwakarma, prayed for bail mainly on the ground that he is poor and
innocent. Investigation relating to him is over. He is ready to remain
abide by the conditions, if any, imposed, etc.
3. Ld. A.P.P. objected to it stating that offence is serious and huge
amount involved. The amount of Rs.81,000/- transferred in his account,
which shows his connection with the allegation. There is possibility of
tampering, etc.
4. The summary of the first information report, is that informant was
lured by unknown persons informing that he have to complete certain
easy tasks and earn handsome income. An amount of Rs.30 lacs has been
fraudulently obtained by unknown persons from the informant.
5. The record of investigation reflects that accused is not directly
connected with the allegations. He arrested just because some amount of
about Rs.81,000/- is transferred to his account. It is noticed that for this
reason only he has been arrested. Therefore, there appears doubt about his
actual involvement in the alleged acts.
5. Accused is in custody since long. The investigation relating to
accused is over and charge sheet already filed. The evidence is of
electronic and documentary nature, mainly in custody of the third parties.
As such possibility of tampering is almost nil. Offence is triable by this
Court itself. Accused is ready to remain abide by the conditions. He is
also ready to deposit the amount of Rs.81,000/- transferred in his account.
The conclusion of trial will take much time. Considering all these aspects

and facts and circumstances and reasons assigned in the bail application
following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.5,000/- and depositing Rs.81,000/- (Rs. Eighty One Thousand only) in
the court. Permission granted to deposit cash security instead of surety
bond.
c. Accused shall furnish his detail address and proof thereof.
d. Informant is at liberty to withdraw the amount deposited by
accused.
