Order Details: Bail Order Pdf Text: C. C. No. 2725 PW 2021 State Vs Soharab CNR MHMM18-007690-2021 ORDER BELOW BAIL APPLICATION NO.58/2022 1. Perused record. Heard both the sides. 2. The present application is filed under Section 437 of Code of Criminal Procedure for bail mainly on the ground that accused is falsely implicated in the matter and he is innocent. There is no evidence against him. He is poor and permanent resident of Bihar. He is ready to cooperate further for trial and also ready to remain abide by the conditions, if any, imposed. The Ld. A.P.P. objected to it mainly on the grounds that offence is serious and investigation though over, accused may not turned up for trial. 3. The submissions of both the parties are in tune with their respective contentions. 4. The First Information Report and other documents produced show that accused shaking hands with other untraced accused persons obtained certain amount from one of the customer of State Bank of India. It also reflect that by making fake web pages and URL Links containing State Bank of India's name and logo, unknown persons cheated so many persons. It is transpired that accused committed one of such incidence out of those so many incidences. The allegations involved vide amplitude. The other persons not arrested during investigation. The accused is resident of Bihar. If these aspects considered with the reasons assigned it is clear that accused may not turned up for trial and there is every possibility of tampering of evidence pertaining to remaining transactions and accused persons, who are not yet arrested. Therefore, merely because charge sheet is filed and investigation is completed, accused can not be released on bail. Therefore, following order : ORDER Application is rejected.
