ORDER BELOW EXH.1
1. Perused record. Heard Ld. Advocate for the applicant.
2. Today matter is fixed for the recording of verification of the
complainant as her prayer seeking investigation under Section 156(3) of
Code of Criminal Procedure, was rejected. The complaint was filed
against several accused persons, out of them except Accused Nos.1 and 2,
other accused persons settled matter in the mean time and now
complainant is having grudge only against those two accused persons.
3. If the verification is recorded and subsequent proceedings
commenced it may create complications and confusion as other accused
persons are yet arrayed in original complaint, which includes a company.
For avoiding confusion and proceeding further only against concerned
accused persons complainant filed pursis seeking withdrawal of the
present matter with permission to file a fresh complaint only against
concerned accused persons. Complainant is a old lady and there is
substance in submissions. There appears no hindrance in allowing the
prayer with permission to file a fresh complaint. Therefore, order -
ORDER
a. Permission granted to withdraw the present complaint with liberty
to file a fresh complaint against concerned persons.
b. No order as to costs.
