The complainant absent since last so many dates. Advocate for
complainant also absent.
2. Perusal of proceeding shows that delay condonation application
number 273/Misc./2017 was allowed on 06.07.2022. Thereafter, no steps
taken to proceed further with the matter. Complainant has not filed affidavit
of verification statement to be recorded under section 200 of Code of
Criminal Procedure nor taken any steps to comply the same since filing
complaint in the year 2022. It appears that complainant is not interested in
proceeding with the case.
3. There are no sufficient grounds for proceeding against the
accused with the complaint on available material on record. Keeping the file
pending years together without proceeding further by the complainant is
unjustified. Hence, I pass following order.
ORDER
1. Complaint is dismissed under section 203 of Code of Criminal
Procedure.
2. Proceeding stands closed.
3. Order dictated and pronounced in open court.
