ORDER BELOW EXH.01
1. The complainant and advocate absent since last so many
dates. Advocate for accused Mr.Shishir Singh present. He submitted that
matter is settled before the Hon’ble High Court. The case is pending
since year 2021. Despite passing specific order dated 21.10.2024, no
steps taken to proceed further with the matter. Keeping the file pending
years together without proceeding further taking appropriate steps by
the complainant is unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
