ORDER BELOW EXHIBIT - 01
1. Today the matter is taken before this Court in Special Drive. Perused
record. The present final report is filed against the accused mainly in
respect of an offence punishable under Section 285 and 336 of Indian Penal
Code and certain provisions of Cigarettes and Other Tobacco Products
(Prohibition of Advertisement and Regulation of Trade and Commerce,
Production, Supply and Distribution) Act, 2003. The maximum punishment
provided for the main offences is fine and imprisonment upto six months.
2. The alleged incidence occurred on 21.07.2018 and final report is filed
on 18.10.2019. As per Section 468(2)(b) of Code of Criminal Procedure,
the maximum time provided to take cognizance for the offences with which
the accused is charge sheeted is one year.
3. As stated above the alleged incidence occurred on 21.07.2018 and
final report is filed on 18.10.2019, thus cognizance is barred by limitation
and hence, following order :
ORDER
Final report is rejected.
