ORDER BELOW EXH.01
1. This is an application for condonation of delay of 1 day caused
to file the complaint under section 138 of Negotiable Instrument Act.
2. It is contended that applicant could not get some documents due
to misplacing same and therefore the delay has been caused in filing the
complaint.
3. The opponent duly served by Registered Post notice but failed to
appear and file his say.
4. The reason shown for delay is supported by affidavit. The delay
is satisfied. Further, the delay is not intentional nor it will take away the
statutory right of the complainant/applicant. Hence, I pass following order.
O R D E R
1) The delay stands condoned in the interest of justice.
2) The complaint be registered as per Rule.
3) Order dictated and pronounced in open court.
