Order Details: Order Below EX 1 Pdf Text: C. C. No. 2690 PW 2021 State Vs Sanjay CNR No.MHMM18-007513-2021 ORDER BELOW EXH.1 1. Perused record. Heard Ld. A.P.P. 2. Accused was arrested in connection with an offence punishable under Section 380 of Indian Penal Code, on 17.10.2021 and since then in custody. In the meantime charge-sheet was also filed but till date neither accused produced nor anybody appeared on his behalf. 3. The record shows that charge-sheet shows already filed. The allegations are not much serious nature. The fact that neither he produced nor anybody appeared on his behalf clearly reflect that he is very poor and undergone substantial period of detention. The commencement and conclusion of trial will take much time. The prevailing pandemic also justifies the fact that his further detention not advisable. These facts clearly reflect that accused is entitled to bail but on account of poverty and want of proper legal aid till date no formal application for bail has been filed. Merely because such a application is not on record it cannot be said that court is not in a position to consider his case for bail. The above discussed facts and circumstances are of compelling nature and bail needs to be granted. Therefore, as accused is not in a position to either to apply for bail or furnish surety bond or cash bail, in the interest of justice following order - ORDER Accused is released on bail on his furnishing P.B. of Rs.5,000/-.
