Cross-examination of CW No.02- Ms. Nazeeya Farman Siddique by
accused advocate Mr. S. R. Sharma :-
14. I was student in the year 2017. I am an investment
Banker. In the year 2017 my mother was house wife. I know Naaz
Enterprises. In the year 2017 my mother was proprietor of Naaz
Enterprises. Naaz Enterprises is still in existence. The bank account of
Naaz Enterprises is closed in the year 2022. It is true to say that I
have no document to show that my mother was proprietor of Naaz
Enterprises in the year 2017. It is not true to say that my mother was
and is never Propretor of Naaz Enterprises at any point of time.
15. Two cars Hyndai Xcent bearing registration no. MH-
02-EH-0831 and MH-02-EH- 0832 were in the individual name of my
mother. It is not true to say that those vehicles were in the name of
Naaz Enterprises at that time. Prior to the alleged transaction no
written document was executed between my mother and accused.
There was no broker at the time of said deal. No sale agreement,
transfer agreement or Power of Attorney was executed at the time of
alleged transaction. It is true to say that we have no documents to
show that my mother has sold two cars to the accused.
16. It is true to say that we have no delivery papers to

show that my self and my mother had given the delivery of two cars
to the accused. It is true to say that there is no document which
shows that the accused had taken RC Book, Transfer papers and
Insurance paper from my mother. (It is directed to the witness that
don’t over react on the questions ask by the advocate representing the
accused.)
17. I don’t aware about Sonu Tours and Travels.
Question – Are you aware about any transaction between your
mother and Sonu Tours and Travels?
Answer – Accused Sunil Shelar is the proprietor of Sonu Tours and
Travels.
It is true to say that after taking the delivery of the vehicles
the accused get it transferred his name on RC Book and insurance
papers etc. It is not true to say that the name of accused is not
transferred in the place of name of my mother on the papers
mentioned in para no.3 of my affidavit till today. I am not aware that
accused Sunil Shelar is not proprietor of Sonu Tours and Travels. It is
not true to say that my mother never sold two cars to the accused. It
is not true to say that the subject cheque was not issued by the
accused in my presence. Now Exh.12 is shown to me. The contents of
the cheque are written by the accused. I don’t know that accused is
uneducated. I have no idea that the subject cheque is filled by my
mother. It is not true to say that my mother has misused the cheque
by filling the contents in the blank cheque given by the accused.
18. I have no document to show that the accused has

given confirmation to deposit the subject cheque. I am not aware
about the letter dated 28.12.2017 sent by the complainant to the
accused. I don’t know how I mentioned that the complainant sent a
letter to the accused on 28.12.2017. It is not true to say that the
demand notice has not been received by the accused. It is true to say
that I don’t have any document to show that I was the witness of
alleged transaction. It is not true to say that I have don’t have the
personal knowledge of alleged transaction. It is not true to say that
two cars of my mother were sold to any other person and not to the
accused. It is not true to say that since my mother has misused the
subject cheque, the accused is not liable to pay money to my mother.
It is not true to say that I deposing false on the say of my mother. It
is not true to say that my mother has filed false case against the
accused.
