I solemnly affirm on oath that -
My name is : Hasmukh Devji Rambhiya
Age : -- 70 years,
Occupation : Construction Business.
R/o. : Malad West, Mumbai.
Examination-in-Chief of DW-01 by advocate Yogendra Giri for the
accused :
1. I am running construction business in the name of
Rajeshwar Land Developers Pvt Ltd. I am Managing Director of said
company. I know Narendra Pandey being one of the finance broker. In
the year 2015 he approached us to make finance. He asked us cheques
and bill of exchange for providing loan. Said money never come to us.
In the year 2017 I received one notice from Ranjiv Zha regarding
payment which we never received’. I have replied the notice. We had
never transaction with Ranjiv Zha nor we met with each other at any
point of time. He was unknown me. Thereafter we approached Malad
Police Station and also filed Civil suit. I am producing certified copy of
chamber summons in Civil suit No. 3313 of 2017 along with copy of
Police complaint, reply dated 12.04.2018 and certified copy of acquittal
order passed by Ajmer Court. Entire bunch of certified copies produced
along with document list Exh.36 is collectively marked as Exh.37.
2. I have given 54 cheques to Narendra Pandey. He had not
returned those cheques to me. I am not liable to make any payment
against dishonored cheque to the complainant. I have no transaction
with complainant. I am falsely implicated in this case without liability.

Further Cross examination of DW-01 by Adv. Mahendra Singh for the
complainant:
3. It is not true to say that I have given false statement that he
asked us cheques and Bill of Exchange for providing loan. It is not true
to say that I am deposing false that said money never come to us. It is
not true to say that complainant had invested Rs.15 lakhs and against
as a security I have executed Promissory Note in his favour. It is not
true to say that I am deposing false that we had never transaction with
Ranjiv Zha nor we met each other at any point of time. It is not true to
say that the documents of certified copies pertinent to proceeding
before the Judicial Magistrate, Ajmer has not legal concerned with the
concern cases. It is not true to say that I am deposing false that I had no
transaction with the accused. It is not true to say that I am liable to pay
amount of dishonor of cheque to the complainant. It is not true to say

that I have given false evidence on oath.
