Cross examination of CW-01 Mr. Rajiv Jha by advocate Yogendra Giri
for the accused :
16. I know Mr. Narendra Pandey being broker. He is an
agent for investments. There was cordial relations between me and Mr.
Narendra Pandey. There was only one transaction in between me and
Narendra Pandey when I invested money. It is was not the banking
transaction. I can tell what transaction taken place with Mr. Narendra
Pandey. He introduced me and advised me to invest money with
Rajeshwar Land Developers Pvt. Ltd. I paid Rs.15,00,000/- to Mr.
Narendra Pandey for investing the same with accused No.2. It is true to
say that there is difference of ink in the name and signature and date
over cheque Exh.19 now shown to me. I do not know who had written
name of payee ‘Rajiv Zha’ on the cheque. It is true to say that there was
no name of payee and date on the cheque Exh.19. However, I have not
filled the details. The same received from the accused. It may be
possible that the said cheque Exh.19 might be given to Mr. Narendra
Pandey by accused No.1. It may be possible that subject cheque might
have been issued by the accused to Mr.Narendra Pandey towards
security of loan. It is true to say that accused No.1 has not given the
subject cheque directly. I do not know that present cheque is one of the
cheque out of 54 cheques given by accused No.1 to Mr. Narendra
Pandey. It istrue to say that accused have filed case against Mr.

Narendra Pandey before the City Civil Court, Dindoshi bearing Civil
Suit No.3313 of 2017. I can not tell whether subject cheque is obtained
by Narendra Pandey towards security of loan from the accused in the
capacity of Finance Broker. It is not true to say the same cheque is given
by him to me. I am not aware that Narendra Pandey had not given any
loan or amount of investment to the accused. It is not true to say that
he misused said cheque through me by way of present complaint. It is
true to say that there was no direct or indirect bank transaction in
between me and accused. I am aware about filing police complaint by
the accused in Malad Police station on 10.10.2017 in respect of subject
cheque and another cheques. I again say I was not aware on
10.10.2017. I came to know it later on.
17. I am submitting Income Tax Returns. I had not shown
the amount of Rs.15,00,000/- lent to accused in my Income Tax
Returns. I am ready to produce my Income Tax Returns for the relevant
period. It is true to say that till date I have not produced the Income
Tax Returns. It is not true to say that accused had never assured me
about completing the project by the end of January 2018. It is not true
to say that I never call the accused in respect of the transaction and
assurance. It is not true to say that accused never met me nor I was
aware about him. It is not true to say that I sent a message through
What app at the instance of Narendra Pandey to the accused. It is not
true to say that accused never directly gave me the post dated cheque.
It is not true to say that accused never told me to deposit the subject
cheque. It is not true to say that I have filed present false complaint on
the say of Narendra Pandey. It is not true to say the accused is not
aware about whatever transaction taken place in between me and
Narendra Pandey. It is true to say that accused had replied to my

demand notice. It is not true to say that I am abetting the fraud
committing by Mr. Narendra Pandey by aiding him. I do not know who
is Sajjan Singh. It is not true to say that myself, Sajjan Singh and
Narendra Pandey are involved in the fraud. It is not true to say that
there was no transaction in between me and accused. It is not true to
say that I have filed false complaint on the say of Narendra Pandey.
