Read application. Heard advocate Uttam Yadav for accused
who taken on the matter on Board for cancellation of warrant.
2. Perused proceeding. In fact process is not issued against
accused No.4 who appeared in the matter by taking matter on Board.
The same seems to be an inadvertant act. Accordingly, order of bail and
cancellation of warrant came to be passed. However, as the cognizance
of complaint is not taken against accused No.4 by my Ld. Predecessor,
the orders passed on bail application and application for cancellation of
warrant needs to be modified. The accused can not be burdened to pay
cash bail and deposite penalty. Hence, I pass following order.
ORDER
1. The orders passed on bail application and application for
cancellation of warrant stands set aside.
2. The accused is released forthwith.
3. The amount of cash bail and penalty if deposited for
cancellation of warrant be returned forthwith to the accused.
4. Order dictated and pronounced in open court.
