REASONS
Accused No.2 Ganesh Madilingan Harijan is produced before
me through video conference. Charge is framed against him, to which he
voluntarily pleaded guilty. Accused in jail custody since 04.11.2021. Heard
accused in person. He submitted that lenient view may be taken as he is

only earning member of his family. Considering the nature of offence,
antecedents of accused, age of accused and the period of detention already
undergone, I proceed to pass following order :
ORDER
i) Accused No. 2 Ganesh Madilingan Harijan is convicted vide
section 241 of Criminal Procedure Code for the offence
punishable u/sec. 365 r/w 34 of Indian Penal Code. He is
sentenced to suffer R.I. for 2 (Two) months and fine of
Rs.200/ (Rupees Two Hundred only), in default of payment of
fine, he shall undergo further S.I. of 2 (Two) days.
ii) He is convicted vide section 241 of Criminal Procedure Code
for the offence punishable u/sec. 324 r/w 34 of Indian Penal
Code. He is sentenced to suffer R.I. for 2 (Two) months.
ii) Accused is convicted vide section 241 of Criminal Procedure
Code for the offence punishable u/sec. 504 of Indian Penal
Code. He is sentenced to suffer R.I. for 2 (Two) months.
iii) Accused is convicted vide section 241 of Criminal Procedure
Code for the offence punishable u/sec. 506 (I) of Indian Penal
Code. He is sentenced to suffer R.I. for 2 (Two) months.
iv) All sentences shall run concurrently.
v) The accused No.2 is in custody since 04.11.2021. He is entitled
to get benefit of set off for the period of detention already
undergone vide under section 428 of Cr.P.C.
vi) Seized bamboo and sketch pen be preserved for trial of accused
No. 1 & 3.
vii) Copy of this judgment be supplied to accused No.2 free of cost.
