34 of Indian Penal Code and 3, 4 of The Muslim Women (Protection of
Rights on Marriage) Act, 2019. Offence under section 498 (A) r/w.s. 34
of Indian Penal Code is non compoundable. Moreover, Ld. Counsel for
informant filed his application to withdraw the present case. There is no
such provision to withdraw criminal prosecution without prior
permission of appropriate authority. No merit in the application of
informant. Moreover, application filed without consent of Ld. APP. Role
of informant’s lawyer is limited in criminal prosecution. Hence,
application to withdraw the case is rejected.
